Welcome to Belkingtails Holidays! We are a licensed tour operator and destination management company (DMC) based in Sri Lanka, providing curated travel experiences, tours, accommodation, transportation, and related services throughout Sri Lanka and the region.
These Terms & Conditions govern your access to and use of our website, mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
1. Introduction
These Terms & Conditions, together with our Privacy Policy and any other policies referenced herein, form a legally binding agreement between you and Belkingtails Holidays ("we", "us", "our").
By creating an account, browsing the platform, making an inquiry, or booking a tour or travel service, you confirm that you are legally capable of entering into this agreement and that you accept these Terms on behalf of all persons included in a booking.
2. Our Role as Tour Operator & DMC
Belkingtails Holidays operates as a fully licensed tour operator and destination management company. We design, organize, and operate tours and travel experiences, and we contract directly with hotels, transport providers, guides, activity operators, and other service providers on your behalf.
When you book with us, you are entering into a direct contract with Belkingtails Holidays for the delivery of travel services as described in your itinerary and booking confirmation.
3. Use of the Services
- You must be at least 18 years of age to make a booking. Parents or guardians must book on behalf of minors.
- You agree to provide accurate, current, and complete information when making bookings or inquiries.
- The Services may only be used for personal, non-commercial purposes and legitimate travel arrangements.
- We reserve the right to deny or restrict service to any user who violates these Terms or engages in inappropriate conduct.
4. User Accounts
Certain features require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
Belkingtails Holidays may suspend or terminate accounts at its sole discretion, including in cases of misuse, fraudulent activity, or violation of these Terms.
5. Prohibited Activities
You agree not to misuse the platform or engage in any activity that is unlawful, harmful, misleading, or disruptive, including but not limited to:
- Accessing or scraping data using automated tools
- Posting offensive, misleading, or illegal content
- Violating intellectual property or privacy rights
- Attempting unauthorized access to systems or accounts
- Making false bookings or providing fraudulent payment information
6. Bookings & Travel Services
- 6.1 Booking Process
All bookings are subject to availability and confirmation. A booking is confirmed only when you receive written confirmation from Belkingtails Holidays via email or other official communication.
- 6.2 Travel Documents
You are responsible for ensuring you have valid passports, visas, travel insurance, health certificates, and any other documents required for your trip. Belkingtails Holidays can provide guidance but is not responsible for denied entry or travel disruption due to missing or invalid documentation.
- 6.3 Service Providers
While we carefully select and contract with hotels, transport operators, guides, and activity providers, we cannot guarantee against unforeseen circumstances, service failures, or force majeure events beyond our reasonable control.
- 6.4 Itinerary Changes
We reserve the right to make reasonable changes to itineraries due to weather, safety concerns, operational issues, or circumstances beyond our control. We will notify you as soon as reasonably possible and offer suitable alternatives where available.
7. Pricing & Payments
- Prices are quoted in the currency specified (typically USD, EUR, or LKR) and are subject to change until booking is confirmed.
- Prices include services as specified in your itinerary. Additional costs such as optional excursions, meals not specified, personal expenses, tips, and travel insurance are not included unless stated otherwise.
- Prices may be subject to government taxes, tourism levies, fuel surcharges, or currency fluctuation adjustments as permitted by law.
7.1 Pricing
- A deposit (typically 20-50% of total tour cost) is required at the time of booking to secure your reservation.
- Full payment is due as specified in your booking confirmation, typically 30-60 days before departure.
- Payments are processed securely through authorized payment providers.
- Failure to make payment by the due date may result in automatic cancellation of your booking.
7.2 Payment Terms
8. Cancellations, Modifications & Refunds
- Cancellations more than 60 days before departure: Deposit forfeited, remaining balance refunded.
- Cancellations 30-60 days before departure: 50% of total tour cost forfeited.
- Cancellations 15-29 days before departure: 75% of total tour cost forfeited.
- Cancellations less than 15 days before departure or no-show: 100% of total tour cost forfeited.
8.1 Cancellation by You
Cancellation policies vary by tour package and season. The following general terms apply unless otherwise specified in your booking:
Cancellations must be submitted in writing via email to our official contact address.
8.2 Modifications
Requests to modify dates, itinerary, or services are subject to availability and may incur administrative fees plus any additional costs from service providers. Modification requests must be made in writing and are not guaranteed.
8.3 Cancellation by Belkingtails Holidays
We reserve the right to cancel a tour due to insufficient bookings, safety concerns, force majeure, or other circumstances beyond our reasonable control. In such cases, you will receive a full refund or the option to transfer to an alternative tour. We are not liable for any additional expenses incurred.
8.4 Refunds
Approved refunds will be processed within 14-30 business days to the original payment method, subject to bank processing times.
9. Travel Insurance
We strongly recommend that all travelers purchase comprehensive travel insurance covering trip cancellation, medical expenses, evacuation, baggage loss, and personal liability. Belkingtails Holidays is not responsible for costs arising from events covered by travel insurance.
10. Health, Safety & Conduct
10.1 Health Requirements
You must inform us of any medical conditions, disabilities, dietary requirements, or special needs at the time of booking. We will make reasonable efforts to accommodate your needs but cannot guarantee suitability for all activities.
10.2 Traveler Conduct
You are expected to conduct yourself responsibly and respectfully toward other travelers, guides, service providers, and local communities. We reserve the right to remove any traveler from a tour without refund if their behavior is disruptive, dangerous, illegal, or harmful to others.
10.3 Liability for Personal Belongings
You are responsible for your personal belongings at all times. Belkingtails Holidays is not liable for loss, theft, or damage to personal property.
11. User Content & Reviews
By submitting reviews, photos, videos, testimonials, or other content to Belkingtails Holidays, you grant us a worldwide, perpetual, royalty-free license to use, display, reproduce, and distribute such content for platform operation, marketing, promotional, and commercial purposes across all media channels.
You confirm that you own or have necessary rights to the content you submit and that it does not violate any third-party rights or applicable laws.
12. Liability & Disclaimer
- Indirect, incidental, consequential, or punitive damages.
- Personal injury, illness, death, or property damage (except where caused by our proven negligence).
- Delays, cancellations, or service failures caused by third parties or force majeure.
- Loss of enjoyment, disappointment, or emotional distress.
12.1 Limitation of Liability
To the maximum extent permitted by law, Belkingtails Holidays shall not be liable for:
Our total liability for any claim shall not exceed the total amount paid by you for the affected services.
12.2 Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, pandemic, government restrictions, strikes, or supplier failures.
13. Complaints & Dispute Resolution
If you experience any issues during your tour, please notify our guide or local representative immediately so we can attempt to resolve the matter. Complaints made after tour completion may be difficult or impossible to investigate.
Written complaints should be submitted to our customer service team within 30 days of tour completion. We will investigate and respond within a reasonable timeframe.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka, except where consumer protection laws of your country of residence require otherwise.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated via email or website notice. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
