Welcome to Belkingtails Holidays! We are a licensed tour operator and destination management company (DMC) based in Sri Lanka, providing curated travel experiences, tours, accommodation, transportation, and related services throughout Sri Lanka and the region.
These Terms & Conditions govern your access to and use of our website, mobile applications, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
These Terms & Conditions, together with our Privacy Policy and any other policies referenced herein, form a legally binding agreement between you and Belkingtails Holidays ("we", "us", "our").
By creating an account, browsing the platform, making an inquiry, or booking a tour or travel service, you confirm that you are legally capable of entering into this agreement and that you accept these Terms on behalf of all persons included in a booking.
Belkingtails Holidays operates as a fully licensed tour operator and destination management company. We design, organize, and operate tours and travel experiences, and we contract directly with hotels, transport providers, guides, activity operators, and other service providers on your behalf.
When you book with us, you are entering into a direct contract with Belkingtails Holidays for the delivery of travel services as described in your itinerary and booking confirmation.
Certain features require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
Belkingtails Holidays may suspend or terminate accounts at its sole discretion, including in cases of misuse, fraudulent activity, or violation of these Terms.
You agree not to misuse the platform or engage in any activity that is unlawful, harmful, misleading, or disruptive, including but not limited to:
All bookings are subject to availability and confirmation. A booking is confirmed only when you receive written confirmation from Belkingtails Holidays via email or other official communication.
You are responsible for ensuring you have valid passports, visas, travel insurance, health certificates, and any other documents required for your trip. Belkingtails Holidays can provide guidance but is not responsible for denied entry or travel disruption due to missing or invalid documentation.
While we carefully select and contract with hotels, transport operators, guides, and activity providers, we cannot guarantee against unforeseen circumstances, service failures, or force majeure events beyond our reasonable control.
We reserve the right to make reasonable changes to itineraries due to weather, safety concerns, operational issues, or circumstances beyond our control. We will notify you as soon as reasonably possible and offer suitable alternatives where available.
Cancellation policies vary by tour package and season. The following general terms apply unless otherwise specified in your booking:
Cancellations must be submitted in writing via email to our official contact address.
Requests to modify dates, itinerary, or services are subject to availability and may incur administrative fees plus any additional costs from service providers. Modification requests must be made in writing and are not guaranteed.
We reserve the right to cancel a tour due to insufficient bookings, safety concerns, force majeure, or other circumstances beyond our reasonable control. In such cases, you will receive a full refund or the option to transfer to an alternative tour. We are not liable for any additional expenses incurred.
Approved refunds will be processed within 14-30 business days to the original payment method, subject to bank processing times.
We strongly recommend that all travelers purchase comprehensive travel insurance covering trip cancellation, medical expenses, evacuation, baggage loss, and personal liability. Belkingtails Holidays is not responsible for costs arising from events covered by travel insurance.
You must inform us of any medical conditions, disabilities, dietary requirements, or special needs at the time of booking. We will make reasonable efforts to accommodate your needs but cannot guarantee suitability for all activities.
You are expected to conduct yourself responsibly and respectfully toward other travelers, guides, service providers, and local communities. We reserve the right to remove any traveler from a tour without refund if their behavior is disruptive, dangerous, illegal, or harmful to others.
You are responsible for your personal belongings at all times. Belkingtails Holidays is not liable for loss, theft, or damage to personal property.
By submitting reviews, photos, videos, testimonials, or other content to Belkingtails Holidays, you grant us a worldwide, perpetual, royalty-free license to use, display, reproduce, and distribute such content for platform operation, marketing, promotional, and commercial purposes across all media channels.
You confirm that you own or have necessary rights to the content you submit and that it does not violate any third-party rights or applicable laws.
To the maximum extent permitted by law, Belkingtails Holidays shall not be liable for:
Our total liability for any claim shall not exceed the total amount paid by you for the affected services.
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, pandemic, government restrictions, strikes, or supplier failures.
If you experience any issues during your tour, please notify our guide or local representative immediately so we can attempt to resolve the matter. Complaints made after tour completion may be difficult or impossible to investigate.
Written complaints should be submitted to our customer service team within 30 days of tour completion. We will investigate and respond within a reasonable timeframe.
These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka, except where consumer protection laws of your country of residence require otherwise.
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated via email or website notice. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
